Terms of Service

Welcome to Obscura. These Terms of Service ("Terms") govern your access to and use of the Obscura platform, website, and services (collectively, the "Service") operated by Obscura ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, purchasing a ticket, or otherwise using the Service, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and that you accept and agree to be bound by these Terms and our Privacy Policy.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and complete registration information
  • Keep your login credentials secure and not share them with third parties
  • Notify us immediately of any unauthorised access to your account
  • Accept responsibility for all activities conducted through your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Event Creation

Organisers may create and publish events on the Service. By creating an event, you represent and warrant that:

  • You have the legal right and authority to host the event as described
  • All event information (date, time, venue, pricing) is accurate and not misleading
  • You will comply with all applicable laws, regulations, and venue requirements
  • You hold appropriate licences, permits, and insurance for the event
  • You are solely responsible for the event, its attendees, and any incidents that occur

Obscura acts as a platform facilitating discovery and ticketing. We are not the organiser, host, or promoter of events listed on the Service, unless explicitly stated otherwise.

4. Ticket Purchases

When you purchase a ticket through the Service, you enter into a transaction with the event organiser. Obscura facilitates this transaction but is not the seller of the ticket. Key terms:

  • All ticket prices are displayed in the currency specified by the organiser and include any applicable platform fees
  • Payment is processed securely through our payment partner, Stripe
  • Upon successful payment, you will receive a confirmation and digital ticket
  • Tickets are non-transferable unless the organiser explicitly permits transfers
  • We reserve the right to limit the number of tickets per transaction to prevent scalping

5. Refunds and Cancellations

Refund policies are set by individual event organisers. When purchasing a ticket, please review the organiser's refund policy for that specific event. General guidelines:

  • Organiser-initiated cancellations: If an organiser cancels an event, attendees are entitled to a full refund of the ticket price
  • Attendee-initiated refunds: Subject to the organiser's refund policy as displayed at the time of purchase
  • Platform fees: Platform fees are non-refundable except where the event is cancelled by the organiser
  • Disputes: If you believe you are entitled to a refund that has not been honoured, please contact us and we will work to mediate the dispute

6. Platform Fees

Obscura charges a platform fee of 5% on each ticket transaction. This fee covers payment processing, platform maintenance, and customer support. The fee is calculated on the ticket face value and is clearly displayed to the buyer before purchase.

We reserve the right to modify our fee structure with reasonable notice. Any changes to fees will be communicated in advance and will not apply to tickets already purchased.

7. Prohibited Content

You agree not to use the Service to create, share, or promote content or events that:

  • Are unlawful, fraudulent, deceptive, or designed to scam attendees
  • Promote hatred, discrimination, or violence against any individual or group
  • Contain sexually explicit material or exploit minors
  • Infringe upon the intellectual property rights of others
  • Distribute malware, spam, or engage in phishing activities
  • Violate any applicable local, national, or international laws or regulations
  • Involve the sale of controlled substances, weapons, or other restricted items

We reserve the right to remove any content and suspend or terminate any account that violates these restrictions, at our sole discretion and without prior notice.

8. Intellectual Property

The Service, including its design, features, logos, and content created by Obscura, is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our intellectual property without prior written consent.

Content you upload or create on the Service (event descriptions, images, etc.) remains your intellectual property. By posting content, you grant Obscura a non-exclusive, worldwide, royalty-free licence to use, display, and distribute such content solely for the purpose of operating and promoting the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Obscura and its directors, employees, and affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • The conduct, actions, or omissions of event organisers, attendees, or other users
  • Any loss or damage resulting from events listed on the platform, including cancellations, venue issues, or personal injury
  • Interruptions, errors, or downtime of the Service

Our total aggregate liability to you for any claims arising from or relating to the Service shall not exceed the amount you have paid to Obscura in platform fees during the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Obscura and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

You may terminate your account at any time by contacting us or using the account settings. We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms.

Upon termination, your right to use the Service ceases immediately. Any tickets you have purchased remain valid for their respective events, subject to the organiser's policies. Provisions that by their nature should survive termination shall remain in effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
